Gorelli Hernández, Juan (ed.)

In this 14th edition, a completely updated set of regulations is once again offered, an objective pursued since the first edition. During the 2020-2021 period, there have been no shortage of regulatory developments that have been incorporated into this volume. They have fundamentally affected the Workers' Statute: modifications in the matter of training contracts, introducing the contract for dual university training, in order to favor a close relationship between university studies and professional qualification through practical experience. Article 13 was also replaced by a much more limited new wording on distance work. This regulation has also entailed some modification in the Consolidated Text of the Law on Infractions and Sanctions in the Social Order, as well as in Law 36/2011, of October 10, regulating the social jurisdiction, in both cases with the aim of establish adaptations of said legal texts to the new regulation. On the other hand, article 33.2 has been modified in relation to the scope of protection of the Salary Guarantee Fund, to include in it the compensation generated based on arts. 40.1 and 41.3 ET. Within this article 33, a new section 11 has also been incorporated, which affects administrative silence as a mechanism for resolving benefit application files. Royal Decree-Law 28/2020, of September 22, on remote work is also incorporated. It is a rule that faces the increasingly important reality of telework, which is barely regulated by art. 13 of the Workers' Statute and that, to a large extent, is a consequence of the expansion of this type of work as a consequence of the pandemic. This Royal Decree-Law has also involved the incorporation of certain modifications to the Regulatory Law of Social Jurisdiction.
