Democratic societies face extraordinarily sensitive political problems on a daily basis, and it is easy to be tempted to go to court for a final settlement. The examples that the present time offers us are infinite: the Catalan independence process, abortion, euthanasia, homosexual marriage... But is the law really an unappealable instance, situated above politics, that allows us to resolve all ideological conflicts? Doesn't this legal fetishism engender its own form of terror and injustice? Judith N. Shklar, one of the most lucid and thought-provoking thinkers of the second half of the 20th century, was throughout her life a staunch defender of liberal democracy.
