Law 2/2023 introduces the obligation to have internal reporting channels for companies with 50 or more employees, as well as for all State, regional and local Public Administrations and all public sector entities. This obligation is enforceable before 6-13-2023. In the event that they have not implemented this internal complaints channel subject to Law 2/2023 on that date -before 12-1-2023 for companies with less than 250 workers and municipalities with less than 10,000 inhabitants- they may be subject to administrative sanction. Through these internal channels you can notify the commission of crimes as well as serious or very serious administrative offenses in any administrative area (sports, housing, urban planning, traffic, consumption, etc.), as well as offenses of European Union Law that affect in the internal market, including infringements in the field of competition, state aid, public procurement, environmental protection, product safety, transport safety, public health, etc. The work analyzes Law 2/2023, with EFL's own technique, contextualizing its application not only with Directive (EU) 2019/1937, but also with the regulations of the Autonomous Communities, which had previously regulated this issue and which now it has to coexist with the new state regulation that has displaced those aspects in which the latter is contradicted.
